How Long Does a Landlord Have to Return It?

Every state sets a deadline. Here are some key examples:

  • New Jersey: 30 days after move-out (15 days if you gave proper notice)
  • California: 21 days after move-out
  • New York: 14 days after move-out
  • Texas: 30 days after move-out
  • Florida: 15 days if no deductions; 30 days if making deductions

If your landlord misses the deadline, most states allow you to pursue a claim for the full deposit amount plus additional penalties — sometimes double or triple the deposit.

What Can a Landlord Deduct?

Landlords can generally deduct for:

  • Unpaid rent
  • Damage beyond normal wear and tear
  • Cleaning costs if the unit was left in an unreasonable condition

Landlords cannot deduct for:

  • Normal wear and tear (small nail holes, minor scuffs, faded paint)
  • Pre-existing damage that was documented at move-in
  • Repairs that are the landlord’s responsibility under habitability standards

How to Protect Yourself

At move-in: Take timestamped photos and video of every room, every wall, every appliance. Send a copy to your landlord via email so there’s a record.

At move-out: Do the same. Give your landlord a forwarding address in writing — this starts the clock on their deadline in most states.

If they don’t return it: Send a demand letter via certified mail. If they still don’t respond, small claims is usually the fastest and cheapest way to get your money back. No professional representation is needed.
